Construction Company pays $125k to settle EEOC race harassment lawsuit

Allegations of threats, racial slurs and hanging by a noose

JL Schwieters, a Minnesota construction company, will enter into a consent decree and pay $125,000 to settle an EEOC racial harassment lawsuit. EEOC charged the company with creating a hostile work environment and subjecting two black employees with physical threats because of their race. 

The two employees, worked as carpenters between September 2012 and December 2013.  During that time, they were both subjected to racial harassment by a white supervisor which included racially derogatory comments including calling them “n ---r.”   The supervisor also made a noose out of electrical wire and threatened to hang them. 
Along with the financial payout, the company will revise its policies to outline a complaint procedure for complaining of racial harassment.  Schwieters will also conduct management and non-management training on Title VII.  Lastly, the company will report complaints of race discrimination and harassment to the EEOC during the two-year consent decree.
