Molly E. Conway Added to the List of Possible Directors of the OFCCP

Now three attorneys with EEO ties on the potential list to run OFCCP

As reported by Bloomberg BNA, Molly E. Conway is in the mix for the Director of OFCCP position.  Ms. Conway is currently on the Trump administration’s “beachhead” team of temporary political appointees at the Department of Labor (DOL).  Previously, she was a labor and pension counsel for the Senate Health, Education, Labor and Pensions committee.  Prior to that role, she served as a staffer on the House Education and the Workforce Committee and handled equal employment opportunity issues.

Other potential candidates who were in the mix prior to Andrew Puzder’s withdrawal included Leslie Silverman and Paul Kehoe, attorneys with past ties with the EEOC.   Ms. Silverman served as the Vice Chair and Member of the EEOC, and Labor Counsel to the U.S. Senate Health, Education, Labor and Pensions Committee.  She is currently a shareholder at FortneyScott. 

Paul Kehoe currently works for Seyfarth Shaw LLP but previously served as Special Assistant/Attorney Advisor to EEOC Commissioner Victoria Lipnic.  He was involved with EEOC-initiated litigation, systemic litigation, Commissioner charges and requests for approval to file amicus briefs.  Kehoe also negotiated and drafted the final regulations under the Americans with Disabilities Amendments Act, the Genetic Information Nondiscrimination Act, the Age Discrimination in Employment Act and the final enforcement guidance regarding the use of criminal background checks during the hiring process. 

If and when the new labor secretary nominee, Alexander Acosta, is confirmed he will have the responsibility of selecting the future OFCCP Director.
