Update on EEO-1 Pay Data Reporting


EEOC could complete collection of EEO-1 Component 2 pay data by September 30th but must utilize a third party vendor to handle the large volume of data

EEOC informed the court that it could complete collection of the required EEO-1 Component 2 pay data by September 30, 2019, but only if it utilized a third party data collector to do so.  EEOC filed the brief on April 3, 2019 in response to Judge Tanya S. Chutkan’s request for the government to provide the court with its plan to comply with her March 4, 2019 ruling that overturned the stay on the pay data reporting obligation.

Notes in the brief stated that it would take “nine months to modify the EEOC’s current processes to support the collection of large amounts of sensitive Component 2 pay data from 2018.”  Therefore, according to EEOC “utilizing a data and analytics contractor is the only alternative.”

The current deadline to submit Component 1 data (race and gender) is May 31, 2019.
