EEOC Requests to Closure of Component 2 Pay Data Portal and Considers a Proposed Employer Pay Survey

EEOC has filed another motion, after its first motion was denied, seeking an Order deeming Component 2 pay data collection complete or for the Court to provide clarification “regarding the response rate at which the Court will deem the EEOC’s collection to be complete.” 

EEOC has also made notice to the OMB indicating that it is considering initiating a rulemaking that may “include a new reporting requirement by which employers would submit pay data or related information as reasonable, necessary, or appropriate for the enforcement of Title VII and the Equal Pay Act.”

According to the notice, EEOC will revisit the recommendations of a 2012 study commissioned from the National Academy of Science to determine the benefits and burdens of collecting pay data from employers. 

The proposed amendment is forecasted to be published in the Federal Register in September 2020 and will be presented as an Advanced Notice of Proposed Rule Making (ANPRM) which will provide for public review and comment.
